A: Most likely, your auction was cancelled by eBay because it displayed unauthorized reproductions of copyrighted images owned by XanGo, infringed XanGo trademarks, or was an otherwise illegal or unauthorized use of the material displayed. As part of XanGo efforts, we will notify eBay of listings that appear to be infringements of our property rights, and eBay will take the steps necessary to remedy the situation, which includes the cancellation and removal of such listings.
Q: Why did eBay allow me to post my auction in the first place? A: eBay maintains that it cannot conduct a comprehensive pre-screening of their auctions. The fact that eBay permitted your item(s) to be listed for sale does not mean that their sale is legal or that they do not infringe XanGo intellectual property rights. It is the responsibility of the seller to gain the necessary information to determine if he/she is violating XanGo intellectual property rights.
Q: Why was I not notified directly by the company before reporting my actions to eBay? A: In order to protect the integrity of our brand and the confidence of our distributors, we must work as quickly as possible to stop unauthorized and infringing activities. It is simply impractical for the company to try to contact each seller individually and wait for individual responses before having an offending listing removed. Any request by XanGo to terminate an eBay auction is made in good faith, and only after we have conducted a careful and thorough investigation of the situation.
Q: Why was my auction singled out when there are other XanGo auctions currently on eBay? A: We try to ensure that any unauthorized use of our intellectual property is removed quickly. Moreover, all unauthorized or illegal uses are treated equally. If, however, we have missed an auction because it was not available when we conducted our search, we will address it in our next search.
Q: I am an authorized XanGo independent distributor in good standing with the company. Am I allowed to sell the company product(s) on eBay? Q: What if I took an image directly from XanGo company website, and it is not altered in any way. Can I use it on my auctions? A: No. Any unauthorized reproduction, distribution or display of XanGo trademarks or copyrighted images is a violation of applicable laws.
Q: I honestly was not aware that my actions were infringing or unauthorized. I don feel it fair that my current listing should be removed. A: Unfortunately, innocent intent or ignorance on the part of the seller does not work as a legitimate defense under U.S or international intellectual property laws.
