Pioneer Electronics (USA) Inc. (ioneer is the exclusive authorized U.S. importer for Pioneerbrand consumer and industrial electronics, Elitebrand consumer home electronics and Premierbrand consumer mobile electronics. Pioneer is also the exclusive authorized U.S. importer for Pioneerbrand pro DJ equipment. Pioneer distributes Pioneer Eliteand Premierbrand products through qualifed authorized distributors and dealers and, thereby, strictly controls the right to use the Pioneer Eliteand Premiernames, and its logos and trademarks, in connection with the sale of its products. Pioneer does not authorize its distributors or dealers to sell new Pioneer Eliteand Premierbrand products via on-line third-party auction sites, such as eBay. Therefore, with the exception of some computer accessory products, it is false and misleading for an auction seller to claim to have "New" Pioneer Eliteand Premierbrand products for sale because the seller is not authorized by Pioneer to sell the product on such sites, and because it falsely suggests that the purchaser will receive the full array of Pioneer offers (such as a manufacturer rebate) and customer support (such as a manufacturer limited warranty) that consumers can expect from an authorized dealer. Pioneer generally offers a one year limited warranty for new Pioneerbrand products when those products are purchased by a consumer from an authorized Pioneer dealer in the United States, and a two year limited warranty for new Elitebrand and Premierbrand products when those products are purchased by a consumer from an authorized Pioneer dealer in the United States. (Products that are imported by Pioneer Electronics Canada, intended for retail sale in Canada and purchased from an authorized dealer in Canada, must be returned to Canadian authorized service centers for warranty claims. Similarly, products that are purchased from authorized dealers in other countries must be returned to authorized service centers in those countries for warranty claims.) In addition, from time to time, Pioneer offers rebates and other offers to consumers when the consumer purchase products directly from an authorized dealer in the United States. Pioneer is the owner of the copyrights in all pictures, text and graphics on the Pioneer websites. Pioneer is aware that unauthorized sellers attempt to promote the sale of Pioneer Eliteand Premierbrand products by unlawfully copying some or all of these protected materials from its websites and other copyrighted material. Pioneer does not permit or tolerate such unlawful copying.
