Q: Why was my auction terminated? A: Most likely, your auction was removed from the eBay website because it offered for sale unauthorized reproductions of copyrighted images owned by Playboy or counterfeit merchandise featuring one of our trademarks. Playboy regularly monitors the Internet, including auction sites, in order to protect its rights. As part of that effort, Playboy will notify eBay of auction listings containing unauthorized uses of Playboy copyrights or trademarks and eBay will take the necessary action to comply with its user policies, which include removing the auction from the website. Q: Why was my auction singled out when there are other infringing auctions of Playboy merchandise on eBay? A: Playboy is working diligently to ensure that all unauthorized uses of its property are removed from the eBay website. While it is our intent to remove all counterfeit and unauthorized product from eBay, listings are added at a rate and volume which can be difficult to monitor. We do, however, take necessary actions when we learn of infringements and the fact that we do not proceed against all infringements does not affect the fact that the sale of counterfeit and unauthorized product is against the law. Q: Is there an easy way to tell if a product being offered is counterfeit or infringing? A: You can spot many unauthorized items from the auction title and description. Descriptions like ootleg irateand mages found in the public domainare signs that the auction item may be unauthorized. As an eBay user, it is your responsibility to ensure that the item you are attempting to buy or sell is legitimate and authorized. Q: I found all the Playboy images featured in my auction listing on the Internet, in newsgroups or scanned them from magazines I own and burned a CD. Can I sell this CD on eBay? A: No. Any copying, distribution or sale of Playboy images is against the law. Q: You took down my item because I described it as a layboy Bunny. Is it okay to re-list the item under a different name? A: No. Most likely, the problem with your item is that it is an unauthorized product featuring our RABBIT HEAD DESIGN trademark. The auction cannot be re-listed under any title if the item in question is the problem. Q: What if I bought the item from a distributor or via a website? A: It does not matter where you got the unauthorized product or whether you paid for it. If it is unauthorized, it is illegal to sell it. To protect future customers and resellers on eBay, we ask that you please forward the names and contact information of the sources of the unauthorized product or images to Playboy at copyright@playboy.com.
