Brookstone Copyright/Trademark Infringement

     Please be on notice that I'm a representative of Brookstone Stores. Please read the below for which you are in violation of one or multiple copyright and/or trademark infringements.

Copyright Infringement:

What is copyrighted materials?: A copyright protects original works that are presented in a tangible form which can be viewed, reproduced, altered, and/or communicated to and by others; including without limitation, such examples as text, visual materials, photographs, product packaging, and drawings. The owner of a copyright has the exclusive right to use, duplicate, alter, modify, distribute, publish, and display the copyrighted material.

Examples of Materials For Which Brookstone has Copyright Protection:

1. Product packaging

2. Pictures contained in its catalogs and/or posted on its website

3. Product descriptions contained in any of its catalogs, posted on its website, included on its product packaging, and/or included in the product informational insert

4. Pages on brookstone.com

What constitutes copyright infringement?: An individual is liable for copyright infringement if he displays, duplicates, copies, alters/modifies, or uses any of Brookstone's copyrighted materials without Brookstone's express prior consent.

Most Common Types of Copyright Infringement:

1. Use of images from Brookstone's catalogs or website

2. Use of product descriptions from Brookstone's catalogs, website, packaging, or product inserts

3. Use of images or pictures of Brookstone's product packaging

Trademark Infringement:

What is a trademark?: A trademark is a word, phrase, or logo which indicates the source (in Brookstone's case, the retailer) of products and services.

Examples of Brookstone Trademarks:

Brookstone - the word

Brookstone - logo or stylized font

Hard to Find Tools - phrase and logo

Gardeners Eden - phrase and logo

Product Names & Logos - for example FOM and the FOM logo

What constitutes trademark infringement?: An individual is liable for trademark infringement, tarnishment, and/or dilution if he uses Brookstone trademarks in order to imply an association with Brookstone, that Brookstone will support the products as if originally purchased from Brookstone (retail stores, catalog, or website), linking to brookstone.com from the product page, or uses any of Brookstone's trademarks in any way except to indicate the product is a Brookstone product.

Most Common Types of Trademark Infringement:

1. Linking to brookstone.com in order to provide additional product information

2. Stating or implying the seller is in any way associated with or authorized by Brookstone

3. Stating or implying Brookstone will honor product warranties in exactly the same manner as products bought directly from Brookstone

4. Use of our product names in conjunction with other products; "Just like Brookstone's FOM" or "Brookstone Mogu pillow, like FOM"

5. Comparisons with Brookstone products using the name Brookstone or one of Brookstone's product names

6. Using the Brookstone name &/or product names in item descriptions for non-Brookstone products
